Another issue is the Due Process Clause, which guarantees free speech. Unfortunately, due process arguments are made even more difficult by the fact that financial transactions taking place in the United States are involved.

It is unclear whether the Wire Act of 1961 applies to digital wagering. Before the Internet, the Act was designed to work with antiracketeering laws, but it does not cover wagering done through the Internet. Nevertheless, the Department of Justice concluded that the Act covers online legal betting in the U.S. After this ruling, the Department of Justice has allowed states to pass their own gambling laws.

Several other state legislatures have passed their own gambling laws. Twenty-two states have proposed legalizing sports betting. Others, such as Illinois and New York, have asked the Department of Justice for guidance on the digital sale of lottery tickets.

Many other forms of online gambling are not illegal. Among them, virtual poker and sports betting are popular. But, in states such as Nevada, a player is required to play a real-life slot in order to bet. As a result, the State of Nevada is not able to regulate or tax this form of gambling.

However, other states such as Michigan and Ohio have permitted online poker. Both states have enacted poker legislation, though their regulations are somewhat different. Poker is regulated by the Michigan Gaming Control Board, which grants licenses to players.

As for online gambling on horses, it is not yet legalized in the U.S. But, it is a growing concern among horse owners and riders. Racing enthusiasts are hoping that the West Virginia Lottery Interactive Wagering Act will allow interactive betting on horse races and other sporting events. And, in fact, West Virginia has already legalized daily fantasy sports.
